The company voluntary arrangement is one way of rescuing a failing company from going into sequestration. During the moratorium and while in the CVA process, there are certain limitations on continued trading for the company.

First, the company cannot loan or take credit for anything that is at least GBP 250. One exception to this is if the supplier agrees to the credit while cognizant of the fact that the company is under moratorium. Second, it has to prove that it will be available to sustain transactions with the bank and other sources of funds.

During the process, the nominee sees to it that he/she is free of any legal action filed against him/her. There is no law at present that renders the nominee the same level of protection and responsibility as enjoyed by a receiver or liquidator. Hence, there is every effort on the nominee’s part not to veer away from the rescue process.
